| We operate on a budget-maximization philosophy. This means we can work with a variety of budgets and time frames. Naturally, the larger the budget, the more resources we can assign to a project. However, small budgets don't mean lesser product. By letting us know what you've budgeted to spend on an account relationship with us, we can help propose a strategy that makes the most of your resources. | How is my relationship with Moujaes structured? |
Our client-agency relationship is structured through a Terms of Service (TOS) Agreement that covers all the important issues that you'll find working with a studio like ours. The TOS document serves as the foundation of our working relationship.
Once the TOS is agreed to, all of our projects and work together tie back to the master agreement - streamlining the process and making work with our firm a snap. Whenever you need our services, we submit a proposal for your approval that outlines the scope and budget of your project. Upon your signature, we get the ball rolling.

| What are my responsibilities as your client? |
We’re building this relationship together. For it to be successful, it’s important for you to be aware of your responsibilities as well as ours. Clients who have never engaged a creative services firm before are sometimes unaware of how extensive and important their own involvement in the process will be.
Our studio production schedule depends heavily on the participation of our clients. Serious delays in our production schedule can be caused by a number of things, including, but not limited to, a client’s failure to provide necessary information, material or approvals. During these delays, we may have to reassign some of our resources to other projects.
Under the terms of our Terms of Service Agreement, your responsibilities are primarily:
- ensuring on-time payment of all related project fees and costs that are due to our firm;
- coordination of any decision-making with parties other than our Company;
- providing us any content in a form suitable for reproduction or incorporation into your project without further preparation, unless otherwise provided in any proposals; and
- final proofreading and, in the event that you have approved any deliverable but errors, such as, by way of example, not limitation, typographic errors, misspellings, omissions, or mistakes remain in the finished product, you will be responsible for the cost of correcting such errors.

| What are Moujaes' payment terms? |
For clients who utilize our services on a project-by-project basis, we typically propose terms that fit the scope of the project. Unless otherwise specified in our proposals, we require 50% of the project budget before any work will begin and the remaining 50% due upon completion. Payments are all due on Net 15 or 30 terms, depending on the project.
If your firm is retaining our studio, we will have a separate Retainer Agreement along with our Terms of Service that will outline the payment specifics. |

| What is the difference between the terms "drafts/concepts" and "revisions" as used in your proposals? |
- Drafts & Concepts. These terms are interchangeable and describe the number of unique designs or rounds of original creative we will present to you. Our Studio will typically only use a portion of the allotted drafts/concepts in a first presentation to preserve the integrity of the project scope should the client not approve a concept on the first round of submissions. It’s important that you understand that once you have approved a draft/concept, the project moves to the revisions process and you abandon your right to use any remaining unused draft/concept rounds.
- Revisions. This term describes the number of design modifications/revisions that our studio will perform to a selected draft/concept. Typically we provide up to two (2) rounds of revisions to approved concepts unless otherwise indicated on a proposal. Revision rounds do not mean new, unique creative. When a project has moved from the draft/concept phase to the revision process, our Studio will only modify the actual, approved concept. Once the client has approved a revised concept, the client abandons any further revision rounds provided in a proposal and, typically, this means that particular deliverable is completed.

| What happens if the scope needs to change after the project has already begun? |
If you need to change the scope of a project after it has already begun, we will issue a new proposal that will indicate budget and schedule changes based on your requested modifications. You must review, sign, approve and return this new proposal to us before we can continue our work. Please realize that a change in the scope of work will often result in a change in the budget and will often affect the completion date of your project.
A project scope will also change when our clients request more than the allotted number of drafts/concepts or more than two (2) rounds of revisions. For simplicity’s sake, we may choose, at our own discretion, to bill for additional revisions separately instead of issuing a new proposal. |

| What file formats can you provide for project files? |
| We can provide any industry-standard file formats for your project files including PSD, AI, EPS, PDF, JPG, GIF, TIFF, MOV, etc. |

| I needed something designed yesterday. Can you help me? |
| Depending on the load of our production schedule, we're always happy to accommodate those emergency projects. However, our resources are assigned in advance, and to be fair to other clients whose work must be interrupted by a rush job, we will add an additional rush fee (based on a percentage of the project) to your project budget. |

| Fees and costs that may be associated with your project but not in the primary proposal. |
On occasions, we cannot completely estimate all costs associated with a project at the proposal stage as many production and process fees are dependent on approved designs or other project-related variables. Some of these include:
- Printing, fabrication, production and associated mark-ups;
- Travel outside the Austin, Texas metropolitan area;
- Rush fees; and
- Any incidental out-of-pocket expenses including, but not limited to, couriers, shipping, all taxes (applicable sales, use or value added), prints and associated mark-ups.
Estimates will be provided for the following services for your approval prior to expenses being incurred: printing and production costs, models, photography usage rights, illustrations and stock image usage rights. |

| Who owns the copyright for work Moujaes creates for me? |
This is always an important question to ask any firm performing creative services for you.
In most cases, the appropriate copyright(s) of the final work we create for you are yours upon receipt of all payments due to our firm.
Until all related project costs have been paid in full by the client, Moujaes will retain the exclusive copyright to any work we create for you. When you pay in full for a project, your fee specifically buys the rights to own, use, alter, and reproduce the approved, finished piece. We will provide written verification of ownership transfer to you upon balance payment satisfaction.
As is standard in our industry,
your fee does not buy the rights to, or indicate ownership of, the following: concepts, mock-ups, work-up files, sketches, previous document versions, previous drafts/concepts or options that were not chosen, or any other creative design work that was used in the creation of, but not part of, the finished piece. These elements remain the exclusive property of Moujaes.
There may be other intellectual property provisions that your agreement may be subject to. These terms are negotiable at the agreement stage. |

| Can I get access to my digital project files? |
It is common for our clients to want access to digital files containing final approved work. We can provide these files to you through electronic media and we typically provide these files to our clients at the end of a project. We reserve the right to charge you reasonable project management fees and any other fees to cover the cost of delivering your file(s).
We can only transfer digital files of photography, fonts, design tools, design elements and other Third Party materials that you have either purchased the rights or license for, or currently own. If images or photography have been purchased on your behalf by our Company, you are responsible for abiding by the terms of their usage rights. |

| What are your accreditation and promotion policies? |
We retain the right to reproduce, publish and display work we have done for you in portfolios and web sites, and in galleries, design periodicals and other media or exhibits for the purposes of recognition of creative excellence and/or to advertise and market our services. We will be credited with authorship of the work in connection with such uses.
Either party, subject to the other’s reasonable approval, may describe its role in relation to our projects together and, if applicable, the services provided to the other party on its web site and in other promotional materials, and, if not expressly objected to, include a link to the other party’s web site.
It is your responsibility to address any confidentiality concerns with us at project initiation. If your project is confidential in nature, we will be happy to make changes to this policy within your TOS agreement with us. |

| What is your termination policy? |
Any project or the TOS Agreement may be terminated at any time by either party effective immediately upon written notice, or the mutual agreement of the parties, or if certain events that are outlined in our TOS Agreement occur.
Your termination of a project or the TOS Agreement shall not excuse your obligation to pay any invoices or amounts due for work performed or materials or supplies ordered prior to our receipt of your written notice of termination.
In the event of termination of a project or the TOS Agreement, you will be responsible to pay 100% of unbilled work that has been completed and a percentage of all uncompleted work that you previously approved by signing a proposal. You are also responsible for paying all expenses, fees, out of pockets together with any additional costs incurred through and up to, date of termination. |

| Do you provide discounted or pro-bono work for non-profits and charities? |
| Yes, we're always happy to accommodate the budgets of our clients in non-profits and charities. We also offer our services pro-bono to certain clients whose causes we believe in. |
